2. Who owns and operates The Quiz House
The Quiz House is owned, controlled, and managed by Red Shovel. All references to "we", "us", "our", "The Quiz House", or the "Platform" include Red Shovel and the Protected Parties, unless the context clearly requires otherwise.
Red Shovel is responsible for operating the Platform, setting Platform rules, designing Competition formats, determining operational procedures, managing user accounts, appointing suppliers, arranging Sponsor activations, and making final decisions on Platform integrity matters.
Users acknowledge that Sponsors, influencers, advertisers, content partners, payment providers, KYC providers, hosting providers, analytics providers, and other suppliers may assist in delivering parts of the Platform but do not become liable for Platform operation merely because they are involved in a Competition or campaign.
3. Nature of the Platform: skill and knowledge competitions
The Quiz House is positioned and intended to operate as a paid skill and knowledge competition platform. Its core premise is that participants compete by answering factual quiz questions, primarily in football and sports knowledge categories, and are ranked according to objective scoring rules.
The Platform is not intended to be a chance-based, lottery-style, random draw, casino, wagering, or speculative product. Users must not describe or use the Platform in a way that suggests otherwise.
Competition mechanics may include fixed question sets, identical questions for all participants in a room, scoring based on correct answers, completion-time ranking, leaderboard placement, and fair-play controls designed to protect the skill-based nature of the Platform.
No statement on the Platform should be interpreted as a promise of profit, income, investment return, financial gain, guaranteed payout, or guaranteed Reward.
4. Acceptance of these Terms
You accept these Terms when you access the Platform, create an Account, verify your phone number, opt in to WhatsApp messages, enter a Competition, make a payment, receive a Reward, interact with a Sponsor campaign, use a referral link, or otherwise use any Platform service.
If you are using the Platform on behalf of another person, business, brand, club, Sponsor, or organisation, you represent that you have authority to bind that person or entity to these Terms.
If you breach these Terms, we may suspend or terminate your Account, cancel your Entries, remove you from leaderboards, withhold or cancel Rewards, refuse future access, report suspected unlawful conduct, and recover losses from you.
5. Eligibility and age requirements
You may only use the Platform if you are legally capable of entering into binding contracts and participating in paid skill competitions in your jurisdiction.
Unless we expressly state otherwise in writing, you must be at least 18 years old to create an Account, enter paid Competitions, make payments, claim Rewards, or participate in Sponsor activations.
We may require proof of age, identity, residence, phone ownership, banking details, device ownership, or any other verification information before allowing Account access, Competition entry, or Reward fulfilment.
We may restrict or block users from any country, province, region, device, network, payment method, bank account, Sponsor campaign, or category of user where required for legal, regulatory, fraud-prevention, commercial, or operational reasons.
6. Account registration and security
You must provide accurate, current, complete, and truthful information when creating and using your Account. This includes your name, display name, phone number, WhatsApp number, email address, identity information, banking information, and any KYC documents requested.
You are responsible for all activity on your Account, whether authorised by you or not. You must keep your login details, OTPs, devices, WhatsApp access, and payment credentials secure.
You may not create, use, sell, rent, transfer, operate, or control multiple Accounts, use another person's Account, use false details, use synthetic identities, or allow another person to play through your Account.
We may treat all activity from your Account, device, IP address, phone number, browser, payment method, WhatsApp account, or verified identity as activity performed by you.
7. Competition entry rules
Each Competition may have its own room rules, format, opening time, closing time, question count, entry requirement, replay or re-entry rule, leaderboard rule, Reward rule, Sponsor rule, eligibility rule, and verification rule.
You must read and accept the specific rules for each Competition before entering. If a Competition page conflicts with these Terms, we may decide which rule applies in order to preserve fairness, legal compliance, and Platform integrity.
Entries may be single-entry, multi-entry, replay-enabled, evergreen, sponsored, promotional, private, public, invite-only, or limited to specific user groups. Where re-entry is allowed, the Platform may keep your best score, latest score, or another score according to that room's rules.
An Entry is only valid once it is confirmed by the Platform. A payment reference, bank notification, screenshot, WhatsApp message, or attempted transaction does not by itself guarantee a valid Entry.
8. Scoring, rankings, and leaderboards
Unless a Competition states otherwise, ranking is based on objective factors such as number of correct answers, total score, completion time, answer speed, penalties, tie-break rules, and fair-play checks.
The Platform may use time-based tie-breakers, fastest completion, fastest correct answers, or other skill-related ranking rules. Random draws, lucky selections, or chance-based winner selection are not part of the intended core Competition mechanics.
Leaderboards may be provisional until the Competition closes, audit checks are complete, payment status is confirmed, KYC checks are completed, disputes are reviewed, and suspected unfair activity is resolved.
We may correct leaderboard errors, recalculate results, remove invalid attempts, adjust rankings, cancel Entries, or rerun a Competition where necessary to protect fairness, Platform integrity, or legal compliance.
9. Questions, answers, and content accuracy
We take reasonable steps to prepare factual, fair, and answerable questions. However, football and sports records, player data, match details, statistics, club information, historical data, and public sources may contain disputes, ambiguity, translation issues, or later corrections.
We may rely on official competition records, federation records, club records, reputable sports databases, broadcaster records, match reports, and editorial judgement when determining the accepted answer.
If a question is materially wrong, ambiguous, outdated, duplicated, technically defective, or compromised, we may void the question, award credit, remove the question, cancel the room, adjust scoring, rerun the room, or take any other action we consider fair and commercially reasonable.
Our decision on question validity, accepted answers, scoring, and leaderboard treatment is final to the maximum extent permitted by law.
10. Payments and Entry confirmation
Users may be required to make a payment or use an approved credit, voucher, Sponsor access code, or promotional entitlement to enter certain Competitions.
Payments are processed through third-party payment providers. We are not responsible for bank failures, gateway failures, declined payments, delayed confirmations, incorrect references, insufficient funds, payment reversals, chargebacks, payment-provider downtime, or unauthorised use of a payment method.
You must not attempt to manipulate payment systems, use stolen payment instruments, reverse valid payments, submit false proof of payment, exploit payment delays, or claim access without proper confirmation.
We may refuse, delay, reverse, reconcile, audit, or cancel Entries where payment status is uncertain, disputed, suspicious, reversed, charged back, incomplete, duplicated, or inconsistent with Platform records.
No internal commercial calculations, operational costs, or Platform allocation methodology are disclosed or incorporated into these Terms. Users agree that the Platform may manage its commercial operations internally without creating any user entitlement to internal financial information.
11. Rewards and Reward Pools
The Quiz House uses the terms "Rewards" and "Reward Pools". These may include cash-equivalent benefits, wallet credits, vouchers, entry credits, Sponsor benefits, promotional benefits, recognition, or other benefits described for a Competition.
A Reward Pool is a conditional pool of potential Rewards for a Competition. It is not a promise that any particular user will receive a Reward.
Rewards are subject to eligibility, valid Entry, valid payment, valid Account status, compliance with these Terms, completion of KYC, fraud and fair-play checks, technical validation, dispute resolution, Sponsor conditions, and any room-specific rules.
We may pay, credit, deliver, withhold, reverse, cancel, substitute, split, reduce, defer, or forfeit any Reward where permitted by these Terms, required by law, required by a Sponsor condition, required by a payment provider, or necessary to protect Platform integrity.
Rewards have no guaranteed cash value unless expressly stated in the applicable Competition rules and confirmed by the Platform after all validation checks are complete.
12. No Reward guarantee
Entering, paying for, completing, replaying, sharing, referring, ranking, or appearing on a leaderboard does not guarantee that you will receive any Reward.
No Reward is guaranteed until we have confirmed, in our discretion, that all conditions for that Reward have been satisfied. This includes final leaderboard validation, successful payment confirmation, identity verification, compliance checks, anti-cheat checks, Sponsor checks, and any required tax, banking, or regulatory checks.
We may refuse to award or deliver a Reward if we believe that doing so may breach applicable law, expose Red Shovel or any Protected Party to risk, undermine Platform fairness, involve fraud or suspicious activity, conflict with Sponsor requirements, or result from a technical or administrative error.
Any displayed Reward Pool, Reward amount, projected Reward, estimated Reward, provisional ranking, notification, screenshot, or leaderboard position is provisional until formally confirmed by The Quiz House.
13. Reward fulfilment, KYC, tax, and banking checks
Before any Reward is delivered, we may require identity verification, age verification, selfie verification, proof of address, phone ownership checks, bank-account verification, tax information, source-of-funds information, Sponsor eligibility checks, sanctions screening, fraud screening, or any other information reasonably required for compliance or risk management.
You must provide accurate and complete information. If you fail to provide requested information, provide false information, use another person's details, or fail verification, you may forfeit the Reward and your Account may be suspended or terminated.
Rewards may only be delivered to the verified user who earned them. We may refuse third-party bank accounts, mismatched names, shared accounts, business accounts, foreign accounts, proxy accounts, mule accounts, or suspicious payout destinations.
We may deduct, withhold, report, or request information relating to tax, statutory deductions, regulatory obligations, refunds, chargebacks, debts owed to us, or suspicious transactions where required or permitted by law.
You are responsible for your own tax, reporting, banking, and legal obligations arising from any Reward.
14. Sponsor activations and Sponsor data sharing
Certain Competitions, Reward Pools, content, referral links, events, rooms, campaigns, or promotions may be sponsored, co-branded, promoted, or supported by Sponsors.
By entering a sponsored Competition, engaging with a Sponsor campaign, using a Sponsor link, claiming a Sponsor Reward, accepting a Sponsor benefit, or appearing as a winner or ranked participant in a sponsored activation, you agree that we may share relevant information with the applicable Sponsor and its authorised service providers for legitimate Platform and campaign purposes.
Relevant information may include your name, display name, contact details, city or region, Competition entered, Entry status, score, rank, Reward status, eligibility status, referral attribution, content submissions, images or media you choose to provide, and information needed to verify, fulfil, audit, report on, or publicise the sponsored activation.
We will aim to share only information reasonably relevant to the sponsored activation, Reward fulfilment, campaign reporting, fraud prevention, legal compliance, user support, marketing consent management, or Sponsor relationship.
Sponsors may contact you about the relevant activation, Reward, fulfilment, event, campaign, or related opportunity where permitted by law and applicable consent rules. Where direct marketing consent is required, we or the Sponsor will seek it or provide an opt-out mechanism where legally required.
Sponsors are independent parties. We are not responsible for Sponsor products, services, promises, communications, delays, failures, data practices, promotions, or disputes except to the extent that applicable law does not allow us to exclude responsibility.
15. WhatsApp, SMS, email, and Platform communications
You agree that we may contact you through WhatsApp, SMS, email, in-app messages, push notifications, phone calls, social media messages, or other channels for operational, transactional, security, support, Reward, Sponsor, reminder, leaderboard, and promotional purposes where permitted by law.
Transactional and operational messages may include OTPs, Entry confirmations, payment status, room reminders, closing-time alerts, leaderboard updates, Reward notifications, KYC requests, fraud reviews, support replies, and policy updates.
You may opt out of promotional communications where required by law. However, you may still receive operational or transactional messages needed to provide the Platform, protect security, confirm payments, manage Rewards, or comply with law.
You are responsible for any data, network, message, roaming, or device charges incurred when receiving or sending communications.
16. Referral links, influencers, ambassadors, and creators
We may provide referral links, discount codes, promotional codes, access links, creator links, influencer links, ambassador links, or tracking links. These may be used for attribution, Rewards, Sponsor reporting, marketing analytics, and user acquisition.
Referral benefits are discretionary and may be changed, suspended, cancelled, capped, or withdrawn at any time. Referral benefits are conditional on valid users, valid Entries, valid payments, non-fraudulent activity, and compliance with these Terms.
Influencers, ambassadors, creators, Sponsors, and community partners must not use prohibited language, misleading claims, false Reward claims, guaranteed earnings claims, or any statement that conflicts with The Quiz House's skill-based positioning.
We may withhold referral benefits where referrals are fake, self-referred, duplicated, incentivised in a misleading way, generated through bots, generated through spam, generated through paid click manipulation, or otherwise abusive.
17. Fair play, anti-cheat, and prohibited conduct
Fair play is central to The Quiz House. You must not cheat, collude, automate, manipulate, exploit, or interfere with the Platform or any Competition.
Prohibited conduct includes using bots, scripts, macros, automation, answer-sharing groups, unauthorised assistance, screen scraping, OCR tools, browser extensions, remote assistance, multiple devices for one attempt, VPN/proxy abuse, emulator abuse, device spoofing, account sharing, identity sharing, payment fraud, chargeback abuse, leaderboard manipulation, question harvesting, reverse engineering, or any conduct we consider unfair.
You must not copy, reproduce, scrape, distribute, sell, publish, share, or store question banks, answers, explanations, scoring logic, Platform code, leaderboard data, user data, Sponsor data, or other Platform content except as expressly permitted by us.
We may use technical, behavioural, statistical, manual, automated, device, browser, payment, identity, and network signals to detect unfair activity. These may include response times, accuracy outliers, answer patterns, device fingerprinting, IP patterns, tab-switching, repeated attempts, payment anomalies, referral anomalies, and account relationships.
18. Anti-cheat consequences and investigations
If we suspect a breach of fair play, we may investigate without giving prior notice. During an investigation, we may freeze an Account, pause Reward fulfilment, remove leaderboard visibility, request additional verification, cancel Entries, restrict re-entry, or preserve data for review.
If we determine that a breach occurred, we may disqualify you, remove your scores, cancel Rewards, forfeit balances or credits where permitted by law, ban your Account, block your device or payment method, reverse benefits, recover losses, report conduct to authorities, notify payment providers, notify Sponsors, and take legal action.
You agree that our integrity decisions are final to the maximum extent permitted by law. We are not required to disclose detection methods, security signals, fraud models, supplier tools, or internal investigation procedures.
19. Technical issues, outages, and errors
The Platform may experience downtime, bugs, delays, data errors, payment errors, leaderboard errors, question errors, display errors, connection issues, device incompatibility, WhatsApp delays, Sponsor fulfilment delays, or third-party failures.
We do not guarantee uninterrupted, error-free, secure, or always-available service. You are responsible for ensuring that your device, connection, browser, data, battery, and environment are suitable before entering a Competition.
Where a technical issue affects a Competition, we may take any action we consider appropriate, including correcting results, voiding affected attempts, extending a room, closing a room, rerunning a room, issuing credits, refusing refunds, approving refunds, cancelling Rewards, or taking no action.
We are not liable for any loss, disappointment, lost opportunity, alleged lost Reward, rankings, reputational harm, data costs, device costs, bank charges, or other consequences arising from technical issues to the maximum extent permitted by law.
20. Refunds, reversals, chargebacks, and credits
Payments for Entries are generally final once an Entry is confirmed or once a user has accessed or attempted a Competition. We may decide, in our discretion, whether to issue a refund, credit, re-entry, or other remedy in exceptional circumstances.
We may refuse refunds where a user completed or attempted a Competition, breached these Terms, supplied incorrect details, had insufficient connectivity, changed their mind, misunderstood the rules, failed KYC, was disqualified, or experienced issues outside our reasonable control.
Chargebacks, payment disputes, reversals, or false payment claims may result in Account suspension, Entry cancellation, Reward withholding, debt recovery, and future payment restrictions.
Credits, vouchers, Sponsor codes, or free entries may expire, be non-transferable, have no cash value, be limited to specific rooms, and be withdrawn if abused or issued in error.
21. User content, publicity, and winner recognition
You may submit or generate content through the Platform, including display names, profile information, quiz scores, comments, messages, screenshots, score cards, referral posts, images, videos, testimonials, and social content.
You grant Red Shovel a worldwide, perpetual, royalty-free, transferable, sublicensable licence to use, reproduce, publish, display, edit, adapt, distribute, promote, and commercialise user content, scores, display names, testimonials, and winner information in connection with The Quiz House, Platform operations, Sponsor activations, marketing, reporting, public leaderboards, and promotional materials.
You must not submit unlawful, defamatory, abusive, discriminatory, hateful, pornographic, misleading, infringing, private, confidential, or harmful content.
We may remove, edit, moderate, restrict, or refuse user content at any time without liability.
22. Intellectual property
All Platform content, systems, quiz questions, explanations, branding, logos, room names, mechanics, designs, code, databases, user interfaces, leaderboard structures, score cards, social templates, documents, and materials are owned by or licensed to Red Shovel.
You receive only a limited, revocable, non-exclusive, non-transferable licence to use the Platform for personal participation in accordance with these Terms.
You may not copy, modify, reverse engineer, scrape, data mine, reproduce, publish, sell, licence, mirror, frame, or commercially exploit any Platform content or system without our written permission.
All rights not expressly granted are reserved.
23. Privacy and personal information
We process personal information to operate the Platform, create Accounts, verify users, process payments, manage Entries, calculate scores, run leaderboards, fulfil Rewards, support users, detect fraud, comply with law, report to Sponsors, send communications, and improve the Platform.
Personal information may include identity details, contact details, WhatsApp number, device and browser information, payment records, bank details, KYC documents, selfie or biometric verification outputs, location indicators, Entry history, scores, answer times, leaderboard data, communications, referral attribution, Sponsor engagement, and fraud-prevention signals.
We may share personal information with payment providers, KYC providers, fraud-prevention providers, hosting providers, analytics providers, WhatsApp and messaging providers, banks, auditors, legal advisers, regulators, law-enforcement bodies, Sponsors, and operational service providers where reasonably required.
We may transfer or store information outside South Africa where lawful and where appropriate safeguards or lawful bases are used.
Further privacy details should be set out in a separate Privacy Policy, which forms part of these Terms by reference.
24. Sponsored rooms and additional user-facing consent
When you enter a sponsored room, claim a sponsored Reward, interact with a Sponsor campaign, or use a Sponsor-linked promotion, you understand that the Sponsor may need certain information to verify participation, fulfil Rewards, measure campaign performance, prevent abuse, contact winners, and report campaign outcomes.
By participating in such sponsored activity, you consent to The Quiz House sharing relevant participation and contact information with that Sponsor and its authorised representatives for those purposes.
We will not sell your personal information to Sponsors as a general data sale. Sponsor sharing is linked to Platform operations, campaign administration, Reward fulfilment, fraud prevention, reporting, marketing consent, or other disclosed purposes.
If a Sponsor asks for additional marketing consent, that consent should be handled separately where required by law. Declining optional Sponsor marketing should not prevent normal participation unless the specific Sponsor benefit requires Sponsor contact or fulfilment.
25. Responsible use and user acknowledgements
You are responsible for deciding whether to enter any Competition, how often to participate, and how much to spend. You must only participate using funds that belong to you and that you can afford to spend.
The Platform does not provide financial, investment, tax, legal, or professional advice. Nothing on the Platform should be treated as advice to spend money, expect income, or rely on Rewards.
We may provide voluntary limits, cooling-off tools, self-exclusion processes, support referrals, or participation controls where we consider them appropriate or where required by law.
We may suspend or restrict Accounts if we reasonably believe a user is misusing the Platform, acting under duress, breaching law, using unauthorised funds, or creating risk for themselves, other users, Sponsors, or Red Shovel.
26. Consumer protection and no warranties
To the maximum extent permitted by law, the Platform is provided on an "as is", "as available", and "use at your own risk" basis.
We do not warrant that the Platform will meet your expectations, produce any Reward, be uninterrupted, error-free, secure, compatible with every device, free from defects, free from unauthorised access, or available at all times.
We do not warrant the accuracy, completeness, or availability of third-party data, Sponsor content, payment-provider systems, WhatsApp systems, bank systems, social media platforms, internet networks, or user-generated content.
Nothing in these Terms excludes any non-excludable consumer protection right that applicable law does not allow us to exclude. Where a right cannot be excluded, our responsibility is limited to the maximum extent permitted by law.
27. Maximum exclusion of liability
To the maximum extent permitted by applicable law, the Protected Parties will not be liable to any user or third party for any direct, indirect, incidental, special, punitive, exemplary, consequential, economic, reputational, data-related, payment-related, Reward-related, Sponsor-related, or loss-of-opportunity damages arising from or connected to the Platform.
This exclusion applies whether the claim is based in contract, delict, negligence, strict liability, statute, consumer law, data protection law, misrepresentation, unjust enrichment, restitution, equity, or any other legal theory, and whether or not the possibility of loss was foreseeable or notified.
Without limiting the above, the Protected Parties are not liable for failed payments, delayed payments, incorrect payment details, chargebacks, technical failures, downtime, inaccurate questions, scoring errors, leaderboard corrections, Reward non-payment, Reward withholding, disqualification, Sponsor conduct, user conduct, fraud, third-party systems, lost profits, lost data, lost chance, loss of goodwill, or emotional distress.
If applicable law does not allow liability to be fully excluded, the total aggregate liability of all Protected Parties together is limited to the lowest amount permitted by law. If a court or regulator requires a monetary cap despite this exclusion, the cap will not exceed the amount actually paid by the affected user to enter the specific Competition directly giving rise to the claim, and if no such amount was paid, the cap will be zero.
28. Full indemnity in favour of Red Shovel and Protected Parties
You fully indemnify, defend, and hold harmless Red Shovel and all Protected Parties from and against all claims, demands, losses, damages, liabilities, penalties, fines, costs, expenses, legal fees, settlement amounts, chargebacks, investigations, disputes, tax claims, regulator inquiries, Sponsor claims, payment-provider claims, and third-party claims arising from or connected to your use of the Platform.
This indemnity includes claims arising from your breach of these Terms, Account misuse, false information, KYC failure, payment dispute, chargeback, fraud, cheating, collusion, unlawful conduct, infringement of intellectual property, breach of privacy, misuse of Sponsor information, defamatory content, tax failure, unauthorised use of another person's details, or breach of any applicable law.
This indemnity survives Account closure, termination, Competition closure, Reward fulfilment, and the end of your use of the Platform.
29. Disputes, complaints, and final decision-making
If you have a complaint or dispute, you must contact The Quiz House support through the official support channel within 48 hours of the relevant event, unless a longer period is required by law or stated in the Competition rules.
You must provide your Account details, Competition name, date, screenshots, payment reference, device information, and a clear explanation of the issue. We may refuse incomplete, abusive, fraudulent, late, or bad-faith disputes.
We may investigate disputes using Platform logs, payment records, audit trails, answer timestamps, device signals, Sponsor records, KYC records, support records, and other available evidence.
Our decision on Platform integrity, scoring, leaderboard placement, Entry validity, Reward fulfilment, and fair-play matters is final to the maximum extent permitted by law.
30. Account suspension and termination
We may suspend, restrict, or terminate your Account immediately and without prior notice if we believe that you have breached these Terms, created legal risk, engaged in fraud, used multiple Accounts, failed KYC, abused payments, cheated, threatened staff, misused Sponsor activations, or harmed Platform integrity.
Upon suspension or termination, we may cancel Entries, remove leaderboard entries, withhold or cancel Rewards, block payment methods, restrict devices, revoke credits, delete or retain data as legally permitted, and refuse future access.
You may stop using the Platform at any time. Account deletion requests may be subject to retention needed for legal, tax, fraud-prevention, payment, dispute, audit, and regulatory purposes.
31. Changes to Terms, rules, and Platform features
We may update these Terms, room rules, Reward rules, Sponsor rules, privacy notices, payment methods, scoring systems, eligibility requirements, and Platform features at any time.
Changes may apply immediately where required for legal compliance, security, fraud prevention, Platform integrity, Sponsor requirements, or urgent operational reasons. Otherwise, we may provide notice through the Platform, WhatsApp, email, or another reasonable channel.
Continued use of the Platform after changes become effective means that you accept the updated Terms.
32. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa, unless mandatory law requires otherwise.
You agree that South African courts have jurisdiction over disputes arising from or connected to these Terms or the Platform, subject to any mandatory consumer-law forum rights that cannot be excluded.
We may seek urgent, interim, injunctive, debt-recovery, fraud-prevention, or intellectual-property relief in any competent court or forum.
33. General legal provisions
If any part of these Terms is unlawful, invalid, or unenforceable, that part will be limited or severed to the minimum extent necessary, and the rest of the Terms will remain in force.
Our failure to enforce any right is not a waiver of that right.
You may not transfer your Account, Entries, Rewards, credits, claims, or obligations without our written consent. We may transfer, assign, subcontract, or restructure the Platform or these Terms as part of our business operations.
These Terms, together with any Privacy Policy, room rules, Sponsor rules, payment rules, and other referenced policies, form the entire agreement between you and Red Shovel regarding the Platform.
34. Contact details and notices
Official notices to The Quiz House must be sent through the support channel, email address, or legal-notice address published on the Platform.
Users must keep their contact details current. Notices sent to your registered phone number, WhatsApp number, email address, Account inbox, or published Platform channel will be treated as received when sent, unless applicable law requires otherwise.
